CS FOR SENATE BILL NO. 32(RES) "An Act relating to the sale of                                                                  
timber on state land; and providing for an effective date" was read the                                                         
third time.                                                                                                                     
                                                                                                                                
Senator Egan moved that the bill be returned to second reading for the                                                          
purpose of a specific amendment, that being Amendment No. 1.

     Insert a new bill section to read:                                                                                         
"* Sec. 2. AS 38.05.115 is amended by adding a new subsection to                                                              
read:                                                                                                                           
          (d) Timber from a state forest resource management area                                                               
     established under AS 41.15 may not be sold unless there is an                                                              
     employee of the department qualified as a forester who is                                                                  
               (1) stationed in or within 10 miles of the state forest                                                          
     resource management area; and                                                                                              
               (2) available to supervise the disposal of the timber                                                            
     offered for sale."

"* Sec. 4. AS 38.05.123(a) is amended to read:                                                                                
     (a) Notwithstanding the provisions of AS 38.05.115(a) - (c)                                                            
     [AS 38.05.115] and 38.05.120, and upon a finding that the sale is                                                          
     in the best interest of the state, the commissioner may negotiate a                                                        
     sale of timber for use in the local manufacture of high value-added                                                        
     wood products. A timber sale contract entered into under this                                                              
     section may provide for a harvest of up to 10,000,000 board feet                                                           
     of timber each year, consistent with sustained yield principles, and                                                       
     may be for a term of up to 10 years. Initial stumpage rates for a                                                          
     contract under this section shall be determined by negotiation but                                                         
     may not be less than the base price for the area as established                                                            
     under regulations adopted by the commissioner. A contract under                                                            
     this section must provide that stumpage rates shall be                                                                     
     redetermined by negotiation at least once every three years during                                                         
     the term of the contract, to reflect changes in market conditions;                                                         
     the redetermined rates may not be less than the base price for the                                                         
     area    as    established    under    regulations     adopted     by    the

commissioner. The commissioner shall by regulation set a maximum                                                                
number of contracts, but not less than two, per region of the state that                                                        
may be negotiated each year under this section."
